Welcome to hy. ACTIVEWEAR

These Terms & Conditions govern your use of the hy. website and the purchase of products from us. By using our website and placing an order, you agree to be bound by these terms.

1. About Us

hy. is a UK-based activewear brand created for girls aged 8–14, designing thoughtfully made pieces that encourage confidence, movement and active lifestyles.

2. Placing an Order

When you place an order through our website, you will receive an email confirming that we have received it. This does not mean your order has been accepted.

A contract between you and hy. is formed once your order has been accepted and dispatched.

​

We reserve the right to refuse or cancel any order if:

  • The product is unavailable;

  • We identify an error in pricing or product information;

  • We suspect fraudulent activity;

  • We are unable to obtain payment authorisation.

 

If payment has already been taken, a full refund will be issued.

3. Product Information

We aim to ensure all product descriptions, images, sizing information and prices are accurate.

As our products are photographed and viewed on different screens, colours may vary slightly from those shown online.

​

Measurements and sizing guides are provided as guidance only.

4. Pricing and Payment

All prices displayed on our website are shown in Pounds Sterling (£) and include VAT where applicable.

Payment must be received in full before your order is processed and dispatched.

​

We use secure third-party payment providers to process transactions. We do not store your payment details.

5. Pre-Orders

From time to time, hy. may offer products on a pre-order basis.

Estimated dispatch dates for pre-order items are provided as guidance only and may be subject to change due to manufacturing, customs or shipping delays beyond our control.

If your order contains both pre-order and in-stock items, your order may be shipped together once all items become available unless otherwise stated.

If there are significant delays, we will keep you informed.

6. Delivery

We currently deliver to the United Kingdom and selected international destinations.

​

Delivery times are estimates and cannot be guaranteed.

​

hy. is not responsible for delays caused by postal services, customs procedures, adverse weather conditions or circumstances beyond our reasonable control.

​

Customers are responsible for ensuring that delivery information is accurate at the time of ordering.

​

Additional customs duties or import taxes for international orders are the responsibility of the customer.

7. Returns and Exchanges

We hope you love your hy. purchase, but if you change your mind, you may return eligible items within 14 days of receiving your order.

Returned items must:

  • Be unworn and unused;

  • Have all original tags attached;

  • Be free from marks, stains, odours or damage;

  • Be returned in their original condition.

  • ​

For hygiene reasons, we reserve the right to refuse returns that do not meet these requirements.

If you require a different size, we are happy to offer exchanges subject to availability.

Nothing in these terms affects your statutory rights under UK consumer law.

8. Promotions and Free Gifts

Promotions, discount codes and free gift offers are subject to availability and may be withdrawn or amended at any time.

Unless otherwise stated:

  • Only one promotion can be used per order;

  • Free gifts cannot be exchanged for cash or alternatives;

  • If an order qualifying for a free gift is returned and the qualifying conditions are no longer met, the free gift must also be returned.

 

For launch promotions such as our Founding 30 offer, gifts are allocated on a first-come, first-served basis while stocks last.

9. Intellectual Property

All content on this website, including but not limited to logos, designs, images, graphics, product names, text and branding, belongs to hy. and may not be copied, reproduced, distributed or used without our prior written permission.

10. Limitation of Liability

To the fullest extent permitted by law, hy. shall not be liable for any indirect, incidental or consequential losses arising from the use of our website or the purchase of our products.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under UK law.
